Kullanım Şartları

Bu Kullanım Şartları ("Şartlar"), BebTak uygulamasını ("Uygulama") kullanımınızı düzenler. Uygulamayı indirerek veya kullanarak bu Şartları kabul etmiş sayılırsınız. Ayrıca iOS kullanıcıları için Apple'ın Standart Lisans Sözleşmesi (EULA) de geçerlidir.

1. Hizmet Tanımı

BebTak, ebeveynlerin bebeklerinin beslenme, uyku, büyüme ve sağlık bilgilerini takip etmelerine yardımcı olan bir mobil uygulamadır. Uygulama tıbbi tavsiye, teşhis veya tedavi sunmaz.

2. Kullanım Koşulları

• Uygulamayı yalnızca kişisel ve ticari olmayan amaçlarla kullanabilirsiniz
• Girdiğiniz verilerin doğruluğundan siz sorumlusunuz
• Uygulamayı yasa dışı amaçlarla kullanamazsınız
• Uygulamanın güvenliğini tehlikeye atacak girişimlerde bulunamazsınız

3. Hesap ve Kimlik Doğrulama

Uygulamayı hesap oluşturmadan kullanabilirsiniz. Apple Kimliği ile giriş yapmak isteğe bağlıdır ve Premium özellikler ile bulut senkronizasyonu için gereklidir. Hesap güvenliğinden siz sorumlusunuz.

4. Premium Abonelik ve Satın Almalar

• Premium özellikler uygulama içi satın alma (IAP) yoluyla sunulur.
• Abonelikler Apple App Store üzerinden işlenir ve Apple'ın ödeme koşullarına tabidir.
• Otomatik Yenileme: Aboneliğiniz, mevcut dönemin bitiminden en az 24 saat önce otomatik yenileme kapatılmadığı sürece otomatik olarak yenilenir.
• Yenileme Ücreti: Yenileme ücreti, mevcut dönemin bitiminden önceki 24 saat içinde hesabınızdan tahsil edilir.
• Yönetim ve İptal: Aboneliklerinizi yönetebilir ve satın alma işleminden sonra Hesap Ayarlarınıza giderek otomatik yenilemeyi kapatabilirsiniz.
• İadeler: Satın alma işlemi sonrası kullanılmamış dönem için iade, tamamen Apple'ın iade politikasına tabidir.

5. Aile Paylaşımı

Aile Paylaşımı özelliğini kullandığınızda, davet ettiğiniz kişilerle bebek verilerinizi paylaşmayı kabul edersiniz. Kimleri davet ettiğinizden ve paylaşılan verilerden siz sorumlusunuz.

6. Fikri Mülkiyet

Uygulama ve içeriği (tasarım, kod, grafikler, sesler) Geliştirici'nin mülkiyetindedir. Size verilen lisans, kişisel kullanım için sınırlı, münhasır olmayan ve devredilemez bir lisanstır.

7. Sorumluluk Sınırlandırması

• Tıbbi Sorumluluk Reddi: BebTak bir sağlık uygulaması değildir. Uygulama tarafından sağlanan bilgiler yalnızca bilgilendirme amaçlıdır ve tıbbi tavsiye yerine geçmez. Sağlık endişeleri için her zaman bir sağlık uzmanına danışın.
• Veri Kaybı: Yerel cihazda saklanan verilerin kaybından (cihaz arızası, kayıp, çalınma) Geliştirici sorumlu değildir. Verilerinizi korumak için Premium senkronizasyon özelliğini kullanmanızı öneririz.
• Hizmet Kesintisi: Uygulama "olduğu gibi" sunulur. Planlı veya plansız kesintiler yaşanabilir. Geliştirici, hizmet kesintisinden kaynaklanan zararlardan sorumlu tutulamaz.
• Azami Sorumluluk: Geliştirici'nin toplam sorumluluğu, her durumda son 12 ayda Uygulama için ödediğiniz tutarı aşamaz.

8. Garanti Reddi

Uygulama "olduğu gibi" ve "mevcut haliyle" sunulur. Geliştirici, açık veya zımni hiçbir garanti vermez; bu, ticari elverişlilik, belirli bir amaca uygunluk ve ihlal etmeme garantilerini de kapsar ancak bunlarla sınırlı değildir.

9. Hesap Sonlandırma

• Hesabınızı istediğiniz zaman uygulama içinden silebilirsiniz
• Bu Şartları ihlal etmeniz durumunda hesabınız askıya alınabilir veya sonlandırılabilir
• Hesap silindiğinde sunucudaki verileriniz kalıcı olarak silinir

10. Değişiklikler

Bu Şartları zaman zaman güncelleyebiliriz. Önemli değişikliklerde uygulama içi bildirim yapılır. Güncellemeden sonra Uygulamayı kullanmaya devam etmeniz, yeni Şartları kabul ettiğiniz anlamına gelir.

11. Uygulanacak Hukuk

Bu Şartlar Türkiye Cumhuriyeti yasalarına tabidir. Uyuşmazlıklar Türkiye mahkemelerinde çözüme kavuşturulur.

These Terms of Service ("Terms") govern your use of the BebTak application ("App"). By downloading or using the App, you agree to these Terms. For iOS users, Apple's Standard License Agreement (EULA) also applies.

1. Service Description

BebTak is a mobile application that helps parents track their baby's feeding, sleep, growth, and health information. The App does not provide medical advice, diagnosis, or treatment.

2. Conditions of Use

• You may use the App only for personal, non-commercial purposes
• You are responsible for the accuracy of the data you enter
• You may not use the App for unlawful purposes
• You may not attempt to compromise the security of the App

3. Account and Authentication

You can use the App without creating an account. Signing in with Apple ID is optional and required for Premium features and cloud synchronization. You are responsible for your account security.

4. Premium Subscription and Purchases

• Premium features are offered through in-app purchases (IAP).
• Subscriptions are processed through Apple App Store and are subject to Apple's payment terms.
• Auto-Renewal: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Renewal Cost: Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Management: You can manage your subscriptions and turn off auto-renewal by going to your Account Settings after purchase.
• Refunds: Refunds for unused portions are subject to Apple's refund policy.

5. Family Sharing

When you use the Family Sharing feature, you agree to share your baby's data with the people you invite. You are responsible for whom you invite and the shared data.

6. Intellectual Property

The App and its content (design, code, graphics, sounds) are the property of the Developer. The license granted to you is a limited, non-exclusive, non-transferable license for personal use only.

7. Limitation of Liability

• Medical Disclaimer: BebTak is not a health application. Information provided by the App is for informational purposes only and does not substitute medical advice. Always consult a healthcare professional for health concerns.
• Data Loss: The Developer is not responsible for loss of data stored locally on your device (device failure, loss, theft). We recommend using the Premium sync feature to protect your data.
• Service Interruption: The App is provided "as is." Planned or unplanned interruptions may occur. The Developer cannot be held liable for damages resulting from service interruptions.
• Maximum Liability: The Developer's total liability shall in no event exceed the amount you paid for the App in the preceding 12 months.

8. Disclaimer of Warranties

The App is provided "as is" and "as available." The Developer makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Account Termination

• You can delete your account at any time from within the App
• Your account may be suspended or terminated if you violate these Terms
• When your account is deleted, your data on our servers is permanently removed

10. Changes

We may update these Terms from time to time. In case of significant changes, you will be notified through the App. Continued use of the App after updates constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of Turkey. Disputes shall be resolved in Turkish courts.
